About these terms

These terms apply to orders placed with The Embroidery Shed Ltd, company number 10699312, at Unit 33, The Clock Tower Business Centre, Works Road, Chesterfield, S43 2PE. “We”, “us” and “our” mean The Embroidery Shed Ltd.

Nothing in these terms removes a consumer's statutory rights. If you buy wholly or mainly for business use, the consumer-only parts do not apply.

Orders and availability

Your order is an offer to buy the products and services shown at checkout. We accept it when we confirm the order and payment is authorised. If we cannot accept or fulfil an item, we will contact you and refund any amount paid for it.

Products are subject to availability. Garment photography and screens can make colours look different, so ask for guidance before ordering if an exact shade is critical. Use the size guide and product measurements to choose sizes.

We may refuse artwork or wording that is unlawful, hateful, threatening, infringing or otherwise inappropriate.

Prices, VAT and payment

Product pages can display prices including or excluding VAT. The checkout shows the order total, VAT, delivery and any discount before you pay. A zero-rated or exempt product may require the qualifying conditions shown with that product.

Payment is normally due when the order is placed. For an agreed business credit account, the invoice terms we confirm in writing also apply. Goods remain ours until we receive cleared payment in full.

Discount codes apply only on their stated terms. They may not combine with a bundle, wearer pack or another offer, and cannot be added after an order is placed.

Artwork and proofs

You are responsible for supplying the right artwork, wording, colours, sizes and placement instructions. New or changed artwork does not enter production until the proof or layout has been approved.

Check every detail carefully. If you request a change after approval, we will tell you about any extra cost and revised lead time before continuing. Thread, print and garment colour can vary slightly from a screen proof.

You confirm that you own the artwork or have permission to let us reproduce it. You remain responsible for third-party trade marks, copyright and other rights in material you provide.

Production and delivery

Standard production is normally 5–10 working days, followed by 1–2 working days for UK delivery. These are estimates, not guaranteed dates. Artwork changes, large orders, stock availability and events outside our reasonable control can affect them.

Tell us before ordering if you have a fixed deadline. Inspect the parcel promptly and report shortages, damage or production errors as soon as possible so we can investigate with the courier and put things right.

Cancellations and returns

Contact us immediately if you need to cancel or change an order. If work has not begun and stock has not been specially procured, we will tell you what can be stopped and whether any cost has already been incurred.

Qualifying items from our standard range can be returned within 28 days of delivery when unused, in original packaging and suitable for resale. Goods made to your specification or embroidered, badged, printed, assembled or specially procured for you cannot be returned simply because you change your mind.

This personalised-goods exception does not affect your rights if an item is faulty, not as described or supplied incorrectly. Contact us before sending anything back so we can confirm the return method.

Faults and order problems

If goods are faulty, not as described or do not match the approved order, contact us with the order number and photographs where useful. We may inspect the item and, where appropriate, repair, replace or refund it in line with your legal rights.

We pay reasonable return costs where the return is due to our error or a confirmed fault. Reporting a problem quickly helps us preserve courier evidence, but a short reporting request does not remove statutory rights.

Our responsibility

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for a loss that was not foreseeable, or for delay caused by an event outside our reasonable control where we take reasonable steps to reduce the effect.

We do not exclude liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or rights that consumer law does not allow us to exclude.

Law, changes and contact

English law applies to these terms. Consumers who live elsewhere in the UK keep the benefit of any mandatory protections and may bring proceedings in the courts available to them.
